The Marshal finds a deputy

Rusty, Rinty, and Rip are visiting their old friend Marshall Higgins and start the process for an army depot since the railroad has tracks into the town now. Two gunmen come into town on the train, Stubb Cull and Jimmy Kling, and when they refuse to give up their guns, Rinty and Rip help. Abe Tyson, Higgins deputy, takes the men to jail. There we learn the three men are in cahoots to take over the town.

When Higgins reads the paper Rusty brought, he learns that his old enemy Kid Hooker has been freed from prison. Higgins lets the two gunmen out of jail to get ready for Kid Hooker. Rip is surprised but Abe tells Rip not to worry. Higgins may think he's the marshal but he, Abe, is the one really in charge. Higgins has the title as assort of sentimental honor. Rip's not sure Higgins sees it that way.

Hooker is coming into town on the train and he figures to take care of Marshal Higgins. Both the Kid and Higgins are 80 years old, but their grudges are real. Rip comes to tell Higgins that his deputy, Abe, is in league with the gunmen and is responsible for helping Kid Hooker out of jail. But Marshal Higgins knew all about it, he knows Abe wants to take over his job and the town.

Marshal Higgins tells Rusty that he is getting tired of all the killing, but he's the Marshal and has to do what needs to be done. Higgins is getting ready for a show down but Abe plans on seeing both men killed. Rip takes care of Kling and then Cull. Higgins and the Kid are shooting at each other but neither man can hit the broadside of a barn but they do shoot up the town. Rinty then captures Abe, and soon the real villains are in jail.

Marshal Higgins is back in charge and hires the Kid as his deputy. Rip has the contracts he needs, so the army will be setting up a supply depot in town.
