My spouse was violent to me and our child. What can I do? - Domestic Abuse
Our courts are very aware of the tremendous harm family violence causes to a child's development and will act to protect spouses and children.
The Judge will look at:
- how recent, frequent and serious the family violence is;
- is there coercive and controlling behaviour towards family member;
- was the child a victim or observer of the family violence
- what harm to the child's physical, psychological and safety and well-being happened as a result of the family violence;
- whether the person responsible for family violence is unable to properly parent;
- what steps has the person responsible for the family violence taken to prevent further family violence;
The courts won't tolerate domestic violence and neither should you.
If you made a mistake and hurt a family member own it and get help. Your family deserves it.
