There is no such criminal charge in the state of New York as "aggravated battery". Some jurisdictions have such a charge like Canada, England and even a few U.S. states like Kansas. In most states, including New York, the charge for causing injury to another person is assault, of which there are several types and degrees depending on the exact nature of the assault and severity of injuries; the equivalent charge to aggravated battery in New York would be assault in the first degree. In New York there is: assault in the third, second and first degree; reckless assault of a child; assault on a judge, peace officer, police officer, fireman or EMT; aggravated assault on a minor under 11; aggravated assault on a police or peace officer and gang assault in the second and first degree.
