They weren't expelling them they were withdrawing their scholarships. Since the Ducks most certainly were not wealthy enough to afford to attend Eden Hall Academy they needed a full ride scholarship in order to attend (which they were awarded under the condition that they would play for the JV Hockey Team). The Board of Directors never wanted the Ducks in Eden Hall in the first place as they felt they weren't worthy enough and "didn't belong", it was Bombay and Dean Buckley who advocated for the Ducks and convinced the Board to award them the scholarships in the first place. If the Board revoked the scholarships the Ducks would no longer be able to afford to attend Eden Hall and therefore would have to go back to Public School. The Board of Directors almost certainly knew that this wasn't legal as the scholarships could only be revoked for "cause" (quitting the team, severe behavior misconduct). What the board didn't count on was Bombay standing up for them as their lawyer (they probably assumed they couldn't afford a lawyer) who convinced them that no judge would see not winning enough hockey games as "cause" to revoke the scholarships and who threatened to sue the school if they proceeded with the cancellations.
