Appeal Judges Refuse To Dismiss Polanski Case

Roman Polanski has lost his bid to have a 32-year-old child sex case thrown out of court.

The Chinatown director, who is currently under house arrest in Switzerland, has been living in exile in Europe since fleeing to France on the eve of sentencing in 1978 after pleading guilty to having sex with a 13-year-old girl at a Hollywood party in 1977.

His attorneys have been fighting to have to the criminal case dismissed and took their argument to a California court of appeal earlier this month.

They accused original trial judge Laurence Rittenband, who died of cancer in 1993, of alleged misconduct and unethical acts more than 30 years ago.

But Polanski's legal team failed to sway the three-judge panel and a unanimous decision was delivered on Monday.

However, the judges insisted allegations of improper conduct would be taken seriously, adding, "We encourage all participating parties to do their utmost to ensure that this matter now draws to a close in a manner that fully addresses the issues of due process and fundamental fairness raised by the events of long ago."

Polanski must now return to the U.S. to answer the charges, but his fate rests in the hands of Swiss officials, who will decide in January whether or not they will agree to the U.S. authority's extradition request. »

The latest film from the Oscar-winning director, currently under house arrest in Switzerland, will be unveiled alongside Martin Scorsese's Shutter Island

The big star of next year's Berlin international film festival may yet prove to be noticeable by his absence – the new picture by Roman Polanski has been selected to premiere at the event, but the director remains in detention in Switzerland.

Polanski's drama, now called The Ghost Writer, is based on a novel by Robert Harris. It tells the tale of a writer recruited to help a disgraced British prime minister produce his memoirs against the backdrop of a possible indictment at the international criminal court. The film stars Pierce Brosnan as the statesman and Ewan McGregor as his hired author. Kim Cattrall and Olivia Williams take supporting roles.

Fugitive director Roman Polanski could be back in the United States by January to face sentencing for having sex with a 13-year-old girl more than 32 years ago. There is no guarantee, however, that he will serve time in jail. Polanski’s lawyers in Los Angeles are said to be working furiously to prevent jail time for the aging director. Embattled director Roman Polanski is holed up in his luxury Swiss chalet for the holidays after he was freed from jail and placed on house arrest.

The Chinatown filmmaker was thrown behind bars in Zurich in September following his arrest on a 32-year-old international sexual assault charge.

He posted $4.5 million (£2.8 million) bail on Thursday and was transferred to an undisclosed location for security reasons in the final hours before he was released.

Polanski was fitted with an electronic monitoring device and by Friday morning was back in the comfort of his own home in Gstaad, where he will serve out his days while he awaits possible extradition to America.

Authorities in California are keen to fly Polanski back to the U.S. to face justice.

Film director confined to property in Gstaad while Swiss authorities decide whether to extradite him to the Us

Roman Polanski today began his house arrest on $4.5m (£2.7m) bail, arriving in the Swiss resort of Gstaad in a police convoy.

The film director was welcomed by his wife, Emmanuelle Seigner, and his children, Elvis, nine, and 16-year-old Morgane, at his Alpine chalet.

He arrived in the resort after persuading the Swiss authorities to end his two-month spell in a Swiss prison pending their decision on whether to extradite him to the Us in a 32-year-old sex case.

Two police cars went into the chalet's garage, which has direct access to the house.

Polanski was unseen behind tinted windows, but police confirmed to the Associated Press that he was in one of the vehicles.

A Swiss court granted Oscar-winning filmmaker Roman Polanski $4.5 million bail on Wednesday, allowing him to remain in the country and under house arrest at his Gstaad ski resort and chalet.  Swiss officials will not appeal the decision and the 76-year-old will be released “as soon as possible” after serving two months in jail.

Polanski is waiting extradition to the United States after pleading guilty to unlawful sex with a minor (a 13-year-old) in 1977.  Polanski served 42 days in a psychological testing facility at Chino State Prison, but fled to France 31 years ago following the evaluation period and before sentencing.

The Swiss are hoping Polanski isn’t a flight risk this time due to the bail amount, his own family, and his age.  The Chinatown director will be subjected to “constant electronic surveillance,” reports the AP.

Veteran movie star Faye Dunaway is facing eviction from her New York City home for allegedly failing to pay her rent.

The Chinatown actress' landlord has threatened to kick her out of the property if she refuses to hand over the $1,920 (£1,200) she is said to owe.

According to TMZ.com, a notice was left on Dunaway's door on 23 October but the star has yet to respond.
